Commencement of Member Appointment Round

Applications are invited by Martin Foley MP, Minister for Mental Health, for appointment of members to the Mental Health Tribunal (the Tribunal).

The Tribunal is an independent statutory tribunal established under the Victorian Mental Health Act 2014 (the Act). The Tribunal is an essential safeguard under the Act to protect the rights and dignity of people with mental illness. The primary function of the Tribunal is to determine whether the criteria for compulsory mental health treatment as set out in the Act apply to a person. The Tribunal makes a Treatment Order for a person if all the criteria in the legislation apply to that person

The Tribunal also conducts hearings concerning a range of matters related to compulsory treatment for mental illness; electroconvulsive treatment; and neurosurgery for mental illness.

Legal members must be admitted to the legal profession in an Australian jurisdiction for a period of no less than 5 years.

Psychiatrist members must be registered under the Health Practitioner Regulation National Law in the speciality of psychiatry.

Registered Medical Practitioner members must be registered under the Health Practitioner Regulation National Law to practise in the medical profession and have knowledge and experience in relation to the treatment of mental illness.

Community members must have a special interest or experience in mental illness; or knowledge and experience relevant to performing the role of a community member of the Tribunal.

Members will be appointed from 09 June 2018 for a period of up to five years. Existing members are eligible for re-appointment.
